Agreeing to these terms

These terms cover your use of the Hallmark Menlo Park Concrete website and any estimate or work you ask us for. If you browse the site, call us, send the form or book an estimate, you're agreeing to them, so please read them first.

If you don't agree, please don't use the site. You can still go back to our home page and call us with questions before deciding anything.

What we do

Hallmark Menlo Park Concrete is a concrete contractor in Menlo Park, CA. We build driveways, patios, sidewalks, steps, garage floors, foundations, footings and retaining walls, and we do decorative and stamped work, concrete cutting and foundation raising. You can read more about our crew on the About page.

What's on this site is general information about the trade. It isn't advice for your property. Every slab depends on the ground it sits on, how water runs across your lot and what's there now, so the plan for your job comes from the estimate and your written contract, not from a web page.

Estimates and pricing

We give free estimates at your property, and asking for one doesn't commit you to anything. The price depends mostly on the size and thickness of the slab, how much old concrete has to come out, how easy it is to get equipment to the work area, the condition of the subgrade, which is the soil and base the new slab sits on, and the finish you choose.

An estimate is based on what we can see before the job is open. Sometimes breaking out an old slab turns up soft or wet soil, tree roots, buried debris or old concrete underneath. If that happens, we'll stop, show you what we found, explain what it means for your slab and give you the added cost in writing. We won't do the extra work until you approve it.

An estimate stays good for the period written on it. After that, material costs may have changed, so we may need to update it.

Scheduling and cancellation

We'll give you a start date and a rough length for the job, but those are targets, not promises. Rain, high heat, concrete supply, inspections and conditions found once the job is open can all move a pour. We won't pour in weather that would leave you with a weak or dusty surface just to stay on schedule, because you'd be living with that slab for years.

After the pour, concrete needs time to cure, which means it has to sit and harden before it can carry weight. We'll tell you when it's safe to walk on and when it's safe to drive on. If the slab is used before then, damage from that use isn't covered by us.

If you need to cancel or reschedule, let us know as early as you can. If we've already ordered materials, set up forms or done other work for your job, you may owe for those costs as set out in your written contract.

Payment terms

Your written contract sets the total price, any deposit, when each payment is due and how you can pay. Changes you approve during the job are added to that total in writing.

If a payment is late, we may pause work until it's made, and we keep any rights California law gives us to collect what's owed for work done and materials supplied.

Your part of the job

We ask that you give our crew safe access to the work area, keep pets, kids and vehicles clear while we're working and while the concrete cures, and tell us about anything buried that you know of, such as sprinkler lines, drain pipes or old utility runs.

You're responsible for knowing where your property lines are and for any rules from a homeowners association. Who is responsible for any permits the job needs is stated in your written contract.

Warranties and what concrete does

Concrete shrinks as it dries, and some cracking is normal. We cut control joints, which are planned grooves in the slab, so that when it does crack it usually cracks along those lines instead of across the middle. Fine hairline cracks, small color differences between pours and slight variation in a broom finish, the light texture that keeps a slab from getting slick, are part of how concrete behaves and aren't defects.

Any warranty on our work is the one written into your contract, and it covers only what it says there. Damage from settling soil we couldn't reasonably have seen, tree roots, heavy loads beyond what the slab was built for, de-icing salts, poor drainage changes made after we leave or use before the concrete has cured isn't covered.

This website and its content are provided as they are. We try to keep it accurate, but we don't promise it's complete, current or free of errors.

Limits on our liability

To the extent California law allows, Hallmark Menlo Park Concrete isn't liable for indirect or consequential losses, such as lost use of your driveway, lost income or costs of alternate parking, arising from our work or from use of this site. Our total liability on any job is limited to the amount you paid us for that job.

Nothing in these terms limits any right you have that the law doesn't allow a contractor to take away.

If something goes wrong

Call us first. Most problems get sorted out when we come back out, look at the slab with you and talk it through, and we'd much rather fix something than argue about it.

If we can't settle it between us, we both agree to try mediation in good faith before going to court. If it still isn't resolved, it will be heard in the state or federal courts serving San Mateo County, California.

Governing law

These terms and any work we do for you are governed by the laws of the State of California, without regard to rules that would apply another state's law.

Changes to these terms

We may update these terms from time to time, and the version on this page is the one that applies. A signed contract for your job keeps the terms that were in place when you signed it unless we both agree in writing to change them.
